For most people, investing in a home is the biggest investment they will make. Code violations jeopardize those investments. The goal of the Village's code enforcement efforts is to gain compliance, not raise revenue. Code enforcement works to keep properties from becoming eyesores in the community, to improve the overall attractiveness of the community which increases the likelihood of economic development, and to improve safety, health, quality of life, and property values.

Common Violations

Common property maintenance violations that can be handled via the process below include:

Broken Siding/Windows     
Rodent Infestation     
Unkept Sheds/Garages 

Moderate to severe peeling paint
Unkept decks, porches, fences
Obstructed/Missing Address Markers


Parking violations, tall grass/weeds, and garbage/junk violations will be handled though police tickets.

Process

While 80% of violations are resolved with informal warnings, the process below becomes necessary when warnings are ignored.

Step 1 - Complaint / Observation

The Village becomes aware of a potential violation from the public or from a code enforcement officer. If you would like to contact the Village regarding a potential code violation, please use the Contact Us form.

Step 2 - Investigation and Warning

A code enforcement officer investigates the complaint and finds the issue a violation or not. If it is a violation, the residence will be tagged with a warning. The property owner then has 7 business days to remedy the violation.

Step 3 - 1st Inspection and Official Notice

After 7 business days from warning, the code enforcement officer will inspect the violation. If the violation persists, an official notice is issued via certified mail. The property owner then has 20 business days to remedy the violation.

Step 4 - 2nd Inspection and Citation

After 20 business days from formal notice, the code enforcement officer will inspect the violation again. If the violation persists, the court process is started with a legal citation served by police. This citation requires the property owner to appear in court.

Step 5 - Court Process and Fines

The Village prosecutes the violation in Kane County circuit court. A minimum fine of $75 will be set in addition to $130 in court fees. Fines can reach $750 per day of violation.
